The competing views
The National Voter Registration Act sets federal requirements for registration and list maintenance. A consent decree is a binding court-approved agreement. The Court also accepted a question about removals within 90 days of a federal election. This selection concerns the disposition of the lower-court judgment on the lead docket, including a reversal or vacatur in part; it is not limited to the state-form requirement.
The RNC argues that states can require citizenship evidence on their own forms and that the consent decree cannot block the challenged requirement. It also disputes the restrictions on removing noncitizens near an election.
In their opposition to review, the respondents argue that federal law limits unnecessary documentary demands and that the existing consent decree remains binding unless properly changed. Their merits response is due after this research snapshot.
